Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of NexusFactum (the "Service"), a product of 1841 Technologies, LLC ("Company," "we," "us," or "our"). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

NexusFactum provides tools to help individuals organize, document, and export evidence related to legal and personal matters, including evidence storage, formatted PDF exports, and supporting documentation tools.

NexusFactum is a documentation and organization tool. It is not a law firm, does not provide legal advice or representation, and does not create an attorney-client relationship. Output generated by the Service — including formatted documents and summaries — should not be relied on as a substitute for advice from a licensed attorney. You're solely responsible for evaluating the accuracy, completeness, and suitability of any materials you create or export using the Service for your matter.

You must be at least 18 years old and capable of forming a binding contract to use the Service. You're responsible for keeping your account credentials confidential and for all activity that occurs under your account. Notify us immediately at support@1841technologies.com if you suspect unauthorized use of your account.

NexusFactum offers multiple subscription tiers — as of the date of these Terms, Pro, Court-Ready, and Single Analysis plans — each with different features and pricing as described on our pricing page. By subscribing, you authorize us and our payment processor, Stripe, to charge your chosen payment method on a recurring basis (where applicable) until you cancel. Fees are non-refundable except as required by law or as expressly stated at the time of purchase. We may change pricing or plan features with advance notice.

You agree not to:

• Use the Service for any unlawful purpose, or to create, store, or distribute fraudulent, falsified, or deliberately misleading evidence;
• Attempt to gain unauthorized access to the Service, other accounts, or our systems;
• Interfere with or disrupt the integrity or performance of the Service;
• Reverse engineer, decompile, or attempt to extract the source code of the Service, except as permitted by law;
• Upload content that infringes the intellectual property or privacy rights of others, or that is unlawful, defamatory, or harmful.

We reserve the right to suspend or terminate accounts that violate this section.

You retain all ownership rights in the Evidence Content you upload to the Service. You grant NexusFactum a limited license to host, store, process, and display your Evidence Content solely as necessary to provide the Service to you, including generating exports you request. We don't claim ownership over your Evidence Content and won't use it for purposes unrelated to operating the Service, except as described in our Privacy Policy.

You're solely responsible for ensuring you have the right to upload and use any content you submit, and for the accuracy of any documentation you generate or export.

The Service — including its software, design, branding, and underlying technology — is owned by 1841 Technologies, LLC and is protected by intellectual property laws. These Terms don't grant you any rights to our trademarks, logos, or branding except as necessary to use the Service as intended.

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any documentation generated through the Service will be accepted by any court, agency, or third party.

To the fullest extent permitted by law, 1841 Technologies, LLC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or legal outcome, arising out of or related to your use of the Service. Our total liability for any claim arising out of these Terms will not exceed the amount you paid us in the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless 1841 Technologies, LLC, NexusFactum, and their officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your Evidence Content, or your violation of these Terms.

You may stop using the Service or delete your account at any time. We may suspend or terminate your access to the Service, with or without notice, if we believe you've violated these Terms or if required by law. Upon termination, your right to use the Service will cease, though certain provisions of these Terms will survive termination, including Sections 3, 7–10, and 12.

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws principles, unless otherwise required by applicable law. Any disputes arising out of these Terms or your use of the Service will be resolved in the state or federal courts located in Illinois, and you consent to the personal jurisdiction of those courts.

We may modify these Terms from time to time. If we make material changes, we'll post the updated Terms with a new effective date and, where appropriate, give additional notice such as email. Continued use of the Service after changes take effect means you accept the revised Terms.
